Whilst the media are off demanding evidence from foreign born MPs of citizenship renunciations, I suspect many of these will come up clean, as it’s a pretty obvious thing to check if you’re foreign born. But less obvious is citizenship acquired through birth for Australian born MPs. Consider the case of Julia Banks, the member for Chisholm, and indeed the only Liberal to win a seat from Labor last election. This is a quote from her bio on the Liberal website:
Julia’s parents are both of Greek heritage – her father migrated to Australia as a 15-year-old boy.
First there is the question of whether Ms Banks’ father took up Australian citizenship before her birth. If he did take up Australian citizenship, the case of Mr. Kardamitsis in Sykes v Cleary suggests that he still kept Greek citizenship unless he actively took steps to renounce. This is doubtful as…
