@ChristchurchCC Deputy Mayor is clueless about the criminal justice system

image In responding to demands for police to crack down on windscreen washers, some of whom intimidate motorists to pay, the deputy mayor of Christchurch showed a cultured ignorance of youth courts. She has never read newspaper reports that show that youth court defendants are never named and their convictions are not held against them as adults. Furthermore, she is unaware of the spent convictions law in New Zealand that expunges most convictions after seven years, especially petty convictions.

I followed the coding by the Guardian despite reservations. Including those struck by police cars in routine accidents, none of them police chases, conflates one database with another and does not touch on the issue of the wisdom of police car chases. Including people who drive cars at police or flee with kidnapped children in a car is stretching the definition of unarmed. The wisdom of shooting at a car with children in it is a separate issue. The safety of the hostage taker is not a responsibility of the police, the safety of the children kidnapped in that car was.

About 10% of police shootings of unarmed people resulted in murder charges and a few of those still under investigation read as suspicious and may result in charges as well as more evidence is gathered.

That 10% figure of police shootings that result in murder charges is much higher if you exclude people who collapsed while in contact with police from underlying poor health either in a struggle or after being tasered – 20 or more out of 62, drove cars at police (3), killed in crossfire (2) or were killed in police car accidents (5). The figure is even higher when you exclude a good number of those who are struggling with police and the police fired in self defence lawfully. That is, if a police officer shoot someone at a safe distance without good cause, they face a high probability of being charged with murder.

The database I used today for the above figure on shooting of unarmed Blacks takes less than an hour to work your way through to code them for yourself, so if you doubt my coding, do your own coding and put up a rival figure. I will even consider a guest blog by you if you lack a forum.

If bikes were not invented until today, would they ever be allowed on the road by road safety regulators. Here is the business case: allow pedestrians to move around at high speed on the road including at night with poor visibility as long as they travel on a metal contraption.

The 820 people killed by police by race in 2015 – updated again

I am surprised that the Guardian did not do this graphical analysis themselves. My analysis below shows the quite a few people were unarmed but many more were carrying guns, knives or other weapons.

You have to read through every individual data entry to work out how many of those killed had guns, and the many of these were shooting at police when they were shot dead. The same legwork is required to find out how many officers are on murder charges after killing civilians.

The large drop in white young white male deaths so dominates figure 1 that it conceals a halving in white female deaths. These measures in figure 1 are not related to propensity to drive a car. It must be hypothesised that women were driving more than they used to in the 1950s and 1960s. Nearly all of the decline in white young female road deaths has been since 1990.

Deaths of black males young black males in the road actually increased in the 1980s before falling again. There has been no change at all really in the number of deaths of young black females since 1950.

The punishment dilemma versus cutting the road toll Norwegian style

Traffic offences are example of the punishment dilemma: there but for the grace of god I as the offender.

That makes voters, most of who drive a car, reluctant to support strong punishments for crimes they might happen to commit somewhat accidentally rather than through some malicious intent.

Traffic offences are the breaches of the law  where ordinary citizens are most likely to have encounters with the police and the courts.

This is where the punishment dilemma between obeying the law and brute self-interest are at their sharpest. Everyone wants other people to obey the law , but they are not so sure about themselves, especially when the punishments are harsh.

Juries would not convict drivers for manslaughter so new offences such death by dangerous driving and by negligent driving were introduced with lighter prison terms. People would get a few months for killing people when drunk.

That has changed in recent decades with a hardening of community attitudes to dangerous driving and drunk driving.

An important reason is that with rising incomes, more people can afford a taxi so they a less likely to go down the steps because they are less likely to be caught in a situation of drink-driving or dangerous driving.

Norway has the strictest drink driving laws in Europe:

  • The maximum blood alcohol content is equal to a small glass of a weak drink and heavy punishments with few second chances.
  • The blood-alcohol limit for impaired driving is .02, with stiffer penalties for every point over that.
  • Driving under the influence of alcohol is punishable by at least 1 day in jail, a heavy fine and the loss of the driver’s license for a year.
  • Driving with a blood alcohol level of over 1.5 may lead to one year of prison.

Many Norwegians take a taxi to parties while others make arrangements to stay over with the hosts.
