This post aims to summarise the highlights of the Supreme Court hearing on 6 December 2016. As mentioned yesterday, as with the reports on the High Court, this report will not be comprehensive. This is because those with the most interest in the case will have watched online or read the transcript. There is also the Supreme Court live blog. It is hoped that this report will simply highlight some of the key moments for those with a more passing interest in the case. The live stream is also available for playback after 24 hours. Many of the arguments made by Counsel mirror arguments below which can be found in the summaries of the High Court hearings on Day 1, Day 2 and Day 3.

GREGOR AISCH and K.K. REBECCA LAI, of The New York Times, have created a great visual of a map that shows the conflicts along the 1,172 miles of the Dakota Access Pipeline. Key altercations have been noted as you scroll downward through the map. Also, blue circles indicate where the pipeline crosses rivers, a point of real concern, especially where plans are to have the pipeline underneath the Mississippi River, which is a recipe for a potential disaster in the making.
The construction of a crude oil pipeline through four states has spurred months of clashes near the Standing Rock Sioux Reservation in North Dakota. Protesters, concerned about the pipeline’s environmental impact, have been trying to stop the construction of its Missouri River crossing.
Though legal disputes about water safety, Native American lands and eminent domain have delayed the project, the pipeline is nearly complete.

Déjà Vu (All Over Again): Yet Another Wind Power Output Collapse Plunges 200,000 South Australian Homes into the Dark Ages

Baseball Player, Manager and great American philosopher, Yogi Berra was famous for his in-eloquent, but somehow prescient and folksy quips. Lines such as “If you come to a fork in the road, take it” and “If the people don’t want to come out to the ballpark, nobody’s going to stop them”, might leave many scratching their heads, but his observation about repeated occurrences out on the ballpark – “It’s like déjà vu all over again” – seems perfectly designed to capture South Australia’s unfolding (and now inescapable) power pricing and supply calamity.
Contrary to Yogi’s warning about how tough it is “to make predictions, especially about the future,” STT has been (correctly) forecasting routine load shedding and mass blackouts for South Australia for years now. Once lauded as “Australia’s Wind Power capital”, thanks to its wind power obsession, SA has become an international laughing stock.
